TELEMEDICINE CONSENT
Please read this Telemedicine Consent carefully before using the LuckyRx platform or receiving telemedicine services from independent healthcare providers or affiliated healthcare entities made available through the Services.
By clicking "I Agree," creating an account, accessing or using the Services, or otherwise affirmatively acknowledging this Telemedicine Consent, you acknowledge that you have read, understood, and agree to this Telemedicine Consent and consent to receive telemedicine services from independent healthcare providers through the Services where applicable.
1. PURPOSE OF TELEMEDICINE SERVICES
LuckyRx LLC ("LuckyRx") provides an online technology platform that facilitates administrative and technological coordination between users and independent licensed healthcare providers and affiliated healthcare entities ("Providers") for telemedicine services.
Telemedicine services made available through the Services are provided exclusively by independent licensed healthcare providers and affiliated healthcare entities, including participating provider organizations and clinicians licensed where required.
Telemedicine involves the delivery of healthcare services using electronic communications, information technology, or other means between a healthcare provider and a patient who are not located in the same physical location.
Telemedicine services may include:
- medical evaluations;
- consultations;
- treatment recommendations;
- prescription-related services;
- communications through asynchronous questionnaires;
- secure messaging;
- telephone interactions;
- audio/video consultations; and
- electronic transmission of medical records, images, prescriptions, and health-related information.
LuckyRx provides technology and administrative services only and is not a healthcare provider, medical practice, pharmacy, or provider group.
All healthcare services are provided solely by independent licensed Providers.
Submission of a questionnaire, payment authorization, account registration, consultation request, product request, or participation in telemedicine services does not guarantee diagnosis, treatment approval, prescription issuance, medication availability, or fulfillment.
Providers independently evaluate patients and exercise sole professional and clinical judgment regarding diagnosis, treatment recommendations, prescribing decisions, and healthcare services.
LuckyRx does not practice medicine, provide medical advice, employ, direct, supervise, or control healthcare providers, interfere with Provider clinical judgment, or independently provide medical care.
2. NATURE OF TELEMEDICINE
Telemedicine differs from traditional in-person healthcare because the patient and Provider are not physically present together.
In connection with telemedicine services, Providers may rely upon information including:
- health questionnaires;
- medical history disclosures;
- photographs;
- identity verification information;
- audio/video technology;
- asynchronous communications; and
- other electronically transmitted information provided by or on behalf of the patient.
You understand and acknowledge that questionnaires, health history responses, medical information, and other information submitted through the Services may constitute a medical intake used by independent licensed healthcare providers to evaluate your condition, determine whether telemedicine services are appropriate, and develop treatment recommendations or treatment plans where medically appropriate.
Providers participating through the Services are licensed where required in the jurisdiction where services are rendered. Provider credentials, specialties, certifications, and qualifications may vary by Provider and jurisdiction.
Providers independently evaluate patients and exercise sole professional and clinical judgment regarding whether telemedicine services are appropriate for a patient's condition and healthcare needs.
Telemedicine may not be appropriate for every medical condition or circumstance. Providers retain sole authority to determine whether telemedicine services are appropriate and whether treatment recommendations, prescriptions, laboratory testing, video consultations, in-person examinations, referrals, or other healthcare services are medically appropriate.
Providers may decline treatment, decline to issue prescriptions, require additional information, request additional evaluation, require an in-person examination, or refer patients for in-person care at any time based upon their independent professional and clinical judgment.
3. POTENTIAL BENEFITS OF TELEMEDICINE
Potential benefits of telemedicine services may include:
- improved access to healthcare services;
- increased convenience;
- reduced travel time and related burdens;
- improved access to licensed healthcare providers;
- more efficient follow-up care;
- continuity of treatment; and
- enhanced coordination of certain healthcare services.
Potential benefits vary by patient and circumstance.
No particular outcome, diagnosis, treatment result, prescription, or health improvement is guaranteed.
4. RISKS OF TELEMEDICINE
Potential risks associated with telemedicine services may include:
- delays in evaluation, treatment, or care resulting from technological failures or interruptions;
- interruptions, delays, or failures involving internet services, software platforms, electronic communications, or equipment;
- unauthorized access to electronic communications or information despite reasonable privacy and security safeguards;
- limitations associated with the absence of an in-person physical examination;
- incomplete, inaccurate, delayed, or omitted health information provided by patients;
- reduced image, audio, video, or transmission quality affecting communication or clinical assessment;
- inability to diagnose, evaluate, or treat certain conditions remotely;
- misunderstandings or communication errors resulting from electronic communications;
- delays involving prescriptions, pharmacy processing, medication availability, shipping, or fulfillment activities; and
- rare privacy, technical, or security incidents beyond the control of Providers or LuckyRx.
Telemedicine services may not be appropriate for all medical conditions, emergencies, or circumstances. Providers may determine that in-person evaluation, additional testing, emergency services, or other healthcare services are medically appropriate.
No technology system can guarantee uninterrupted availability or absolute security.
5. EMERGENCIES
TELEMEDICINE SERVICES ARE NOT APPROPRIATE FOR MEDICAL EMERGENCIES OR URGENT MEDICAL CONDITIONS REQUIRING IMMEDIATE IN-PERSON EVALUATION OR TREATMENT.
If you experience a medical emergency or believe you may be experiencing symptoms including:
- chest pain,
- shortness of breath,
- symptoms of a heart attack or stroke;
- severe allergic reactions;
- severe bleeding;
- loss of consciousness;
- seizures;
- suicidal thoughts or thoughts of self-harm;
- prolonged or painful erections (priapism);
- severe nausea, vomiting, loss of consciousness, or fainting following medication use;
- sudden severe drop in blood pressure, irregular heartbeat, or chest pain following medication use;
- sudden vision changes;
- severe medication reactions; or
- any other serious or emergency medical condition,
you should immediately call 911, contact emergency services, or seek immediate in-person medical attention.
Providers made available through the Services do not maintain emergency response capabilities.
LuckyRx does not monitor messages, communications, questionnaires, or account activity for emergency situations and cannot guarantee immediate review or response times.
If you experience side effects, adverse reactions, worsening symptoms, unexpected medical issues, or concerns relating to treatment recommendations or prescribed medications, seek prompt medical attention or contact a qualified healthcare provider.
If you believe you are experiencing a medical emergency, do not rely on the Services, electronic communications, or messaging functions to obtain emergency care.
6. PRESCRIBING LIMITATIONS
Providers may prescribe medications, recommend treatment, or provide healthcare services only when medically appropriate and permitted under applicable law.
Certain medications, treatments, or healthcare services may not be available through telemedicine or may be restricted under federal or state law.
Providers retain sole professional and clinical judgment regarding healthcare services and treatment decisions.
Providers may:
- deny or decline prescriptions;
- require additional health information;
- require laboratory testing;
- require identity verification;
- require audio or video consultation;
- request additional medical records;
- require in-person evaluation or treatment;
- refer patients for in-person care; or
- discontinue treatment or telemedicine services at any time.
Submission of a questionnaire, payment authorization, account registration, consultation request, product request, or participation in telemedicine services does not guarantee diagnosis, treatment approval, prescription issuance, medication availability, or fulfillment.
Providers may decline treatment, decline to prescribe medications, discontinue treatment, or determine that telemedicine services are not appropriate if telemedicine is determined to be clinically inappropriate, unsafe, prohibited by law, or if sufficient information is unavailable to support clinical decision-making.
Compounded Medications
Services facilitated through the LuckyRx platform may involve independent licensed healthcare providers prescribing compounded prescription medications. You acknowledge, understand, and agree that:
- Compounded medications are customized prescription preparations made by licensed compounding pharmacies. They are not FDA-approved as finished drug products and have not undergone the same pre-market review, testing, and approval process required for commercially manufactured medications.
Products that may be prescribed through the Services may include compounded sublingual tablets that contain one or more active pharmaceutical ingredients.
Depending upon the prescribing provider's independent clinical judgment, such ingredients may include:
- PDE5 inhibitors (such as sildenafil, tadalafil, and/or vardenafil) - agents that support erectile function by increasing blood flow; may cause low blood pressure, headache, flushing, vision changes, or hearing changes; contraindicated with nitrates in any form (including nitroglycerin, isosorbide mononitrate, and recreational nitrates/"poppers") and may interact with alpha-blockers, antifungals, HIV protease inhibitors, and other medications; use may also cause prolonged or painful erections (priapism); if an erection lasts longer than 4 hours, seek emergency medical care immediately;
Important note regarding combination PDE5 inhibitor formulations: Certain compounded formulations available through the Services may contain more than one PDE5 inhibitor (e.g., tadalafil combined with vardenafil). Combination PDE5 inhibitor formulations are not FDA-approved and the clinical evidence base for concurrent multi-agent PDE5 inhibitor use continues to evolve. The additive vasodilatory effects of combining PDE5 inhibitors may increase the risk of hypotension (low blood pressure), dizziness, syncope (fainting), and cardiovascular events compared to single-agent use. The prescribing healthcare provider will independently evaluate whether such a combination formulation is medically appropriate for you based on your individual health history, cardiovascular status, and current medications. You must disclose all cardiovascular conditions, current medications (including all PDE5 inhibitors from any source), and relevant health history to the prescribing provider before receiving any compounded formulation.
- Dopaminergic agents (such as apomorphine) - agents that act on dopamine receptors and may support arousal; may cause nausea, vomiting, dizziness, low blood pressure, or fainting, particularly upon initial use or when combined with other medications; apomorphine has independent blood-pressure-lowering (hypotensive) effects; when combined with PDE5 inhibitors (such as sildenafil, tadalafil, and/or vardenafil), these hypotensive effects are additive and may result in a more significant drop in blood pressure than either agent would produce alone; this combination may increase the risk of dizziness, lightheadedness, fainting, or cardiovascular events, particularly upon standing; you should sit or lie down for at least 20 minutes after use and avoid standing quickly; do not use alcohol in combination with this formulation as it may further enhance hypotensive effects; apomorphine is contraindicated or requires extra caution in patients with cardiovascular disease, hypotension, recent cardiac events, or those taking antihypertensive medications, nitrates, or other vasodilatory agents; inform your prescribing healthcare provider of all medications, supplements, and cardiovascular conditions before use;
- Hormonal agents (such as oxytocin) - peptide hormones that may support aspects of sexual response; individual responses vary and the clinical evidence base for certain applications continues to evolve;
- Nutritional/supportive agents (such as methylcobalamin, a form of Vitamin B12) - generally well-tolerated at standard doses.
You must disclose all medications, supplements, and health conditions to the prescribing healthcare provider prior to treatment, including any cardiovascular conditions, use of nitrates or alpha-blockers, low blood pressure, recent cardiac events, history of priapism, or any other condition that may affect the safety of these medication classes.
The prescribing healthcare provider will independently evaluate whether a compounded formulation is medically appropriate for you. Not all patients will qualify. LuckyRx does not determine or influence prescribing decisions.
Compounded medications are prepared by a licensed compounding pharmacy subject to applicable state board oversight. Compounding pharmacies operate under state pharmacy law and relevant federal standards but are not subject to the same manufacturing standards as FDA-approved commercial drug manufacturers.
If you have questions about the compounded medication, its ingredients, risks, or alternatives, you should raise those questions directly with the prescribing healthcare provider before proceeding with treatment.
Compounded formulations made available through the Services are developed in collaboration between LuckyRx and independent licensed healthcare providers and compounding pharmacies. All formulations are subject to clinical review and approval by independent licensed healthcare providers before being made available through the Services. Individual prescribing decisions remain solely within the professional and clinical judgment of the prescribing healthcare provider.
Medication Responsibilities
You understand that compounded prescription medications may contain multiple active pharmaceutical ingredients and that risks, contraindications, drug interactions, and precautions may vary based on the specific formulation prescribed.
You understand that prescribed medications may involve risks, contraindications, interactions, precautions, side effects, warnings, and other considerations. You agree to carefully review prescription labels, pharmacy-provided materials, medication instructions, and information provided by healthcare providers and pharmacies and to seek medical guidance regarding questions or concerns.
Prescription Renewals and Continued Treatment
You acknowledge, understand, and agree that:
- Continued receipt of prescription medication through the Services requires a valid prescription issued by an independent licensed healthcare provider.
- Independent licensed healthcare providers determine, in their sole professional and clinical judgment and in accordance with applicable law and professional standards of care, the duration of any prescription, the frequency of any required renewal evaluations, and any requirements for updated medical intake, follow-up consultation, or additional information before a prescription may be renewed or continued.
- LuckyRx does not control, direct, or guarantee the issuance of renewed prescriptions. A Provider may decline to renew a prescription, require additional evaluation, or determine that continued treatment is not medically appropriate based upon the Provider's independent professional judgment.
- Fulfillment of subscription orders may be paused if a valid prescription is not in effect. You will not be charged for orders that cannot be fulfilled due to the absence of a valid prescription.
- You are responsible for completing any renewal evaluation required by your healthcare provider in a timely manner to avoid interruption in your subscription fulfillment.
Insurance and Reimbursement
Telemedicine services facilitated through the Services are generally offered on a self-pay basis. Providers, pharmacies, and healthcare entities participating through the Services may not participate in insurance plans or government healthcare programs. Current pricing for LuckyRx subscription plans and products is available at https://luckyrx.com/catalog and is displayed at the time of enrollment.
You understand that fees associated with telemedicine services, consultations, prescriptions, products, or related services may not be reimbursable by Medicare, Medicaid, private insurance plans, or other third-party payors.
7. IDENTITY VERIFICATION AND LOCATION VERIFICATION
You acknowledge, understand, and agree that:
- you must provide truthful, accurate, complete, and current information;
- you may be required to provide government-issued identification or other information necessary to verify your identity;
- Providers and affiliated healthcare entities may verify your identity and eligibility for services;
- Providers and affiliated healthcare entities may verify your physical location at the time telemedicine services are requested or rendered;
- telemedicine services are available only in jurisdictions where the applicable Provider is authorized and licensed to provide care; and
- inaccurate, incomplete, misleading, false, or outdated information may result in delays, denial of treatment, discontinuation of care, refusal to prescribe medications, or termination of access to Services.
You agree not to impersonate another person, misrepresent your identity, falsify information, or seek treatment on behalf of another individual unless otherwise permitted by applicable law.
You are responsible for providing complete, accurate, and current health-related information, including information relating to medications, supplements, allergies, diagnoses, symptoms, prior medical history, and other information requested by Providers.
Failure to provide accurate, complete, and current information may negatively affect diagnosis, treatment recommendations, prescribing decisions, patient safety, and treatment effectiveness.
Providers retain sole professional and clinical judgment regarding diagnosis, treatment recommendations, prescribing decisions, and healthcare services.
8. CONTINUITY OF CARE LIMITATIONS
Telemedicine services made available through the Services are not intended to replace your relationship with your primary care physician or local healthcare providers.
Providers participating in telemedicine services may not have access to your complete medical history, prior healthcare records, laboratory results, medications, treatments, or information maintained by other healthcare providers.
You are responsible for:
- informing your primary care physician and other healthcare providers regarding treatment, recommendations, prescriptions, and healthcare services received through telemedicine services where appropriate;
- obtaining follow-up care as recommended by Providers;
- obtaining emergency medical care when necessary;
- seeking in-person evaluation or treatment when recommended; and
- maintaining ongoing relationships with local healthcare providers where appropriate.
If you do not currently have a primary care physician, you are encouraged to establish an ongoing relationship with a local healthcare provider. You may search for primary care providers in your area here: Find a Primary Care Physician Near Me
LuckyRx does not guarantee the ongoing availability of any specific Provider, healthcare entity, treatment option, prescription, or telemedicine service.
9. Telehealth Consultation Fee Notice
By proceeding, you consent to a telehealth consultation with an independent licensed clinician. A professional medical fee of $20 is included in the amount paid.
